Board votes unanimously against Bauder Pharmacy

The Iowa Pharmacy Board unanimouslyvoted Thursday to deny a request from Bauder Pharmacy to reverse the revocation of its controlled substances license while it appeals the decision.

The board filed charges in May 2012 against Pharmacist Mark Graziano and the pharmacy after an audit found 740,888 hydrocodone pain pills were missing.

Graziano faced 27 administrative charges and the pharmacy 26 charges. In April, the board ruled for an indefinite suspension of Graziano's pharmacist license as well as immediate suspension of the license of Bauder Pharmacy to dispense controlled substances.

Bauder Pharmacy filed a petition for judicial review of the decision in Polk County District Court and filed a petition to stay the revocation and paying of a $25,000 civil penalty.

Thursday, the stay was denied by the board.

The board said it reached the decision because Bauder Pharmacy is not a secure environment for controlled substances, and it failed to show that it is likely to prevail during the judicial review.

Bauder Pharmacy in Des Moines has been in business since 1916.
