Bloody discovery could be clue in mystery of missing Dover Twp. man

Owens Hayden, whose brother Thomas has been missing and presumed dead for several years,testified inYork County Common PleasCourtTuesday in anticipation of a trial next year.

This testimony from Owenscomes nearly 10 years after what are believed to be Thomas's remains were found in a FoodSaver bag on Conewago Road on January 18, 2012.

Virginia Hayden, Thomas's wife,faces charges of first- and third-degree murder, along with other related offences, and wasindicted in a Social Security fraud case earlier this year. She allegedlydefrauded more than $113,000 in benefit payments meant for Thomas after his disappearance.

Police have said Virginia gave various versions of an account that Thomas sought treatment in Mexicofor ALS, Lou Gehrig's Disease. She claimed he died there despite his passport and medical records giving no indication that he travelled or had any symptoms of ALS.

Prosecutors arranged for Owens Hayden, 71, to testify Tuesday-months ahead of when the trial might get underway-because he is older and has a series of undisclosed health issues.

Attorneys for the prosecution and the defense questionedOwens about his communication with Thomas in the years and months leading up to his disappearance and the various relationships between family members.

Owens recounted his communication habits with his brother, any noticeable health changes and the final times he spoke to Thomas. Owens said one of their brothers, Wayne, passed away of ALS in 2006, but he did not see Thomas exhibiting anysymptoms.

Their visits were infrequent, and Owens last saw his brother in person in 2008, keeping in contact over the phone beyond that.

Owens never saw or heard from his brother again after their last annual call in the fall of 2010.

According to prosecution the trial has faced delays as the defense needed to bring in new lawyers.

The trial is set for September of 2022.
