The Court of Appeal has widened the application of the test for informed consent, ruling that in all cases patients must be consulted and advised about their proposed treatment, options, risks and benefits even if the care is a do nothing approach. In W (a child and protected party, by his mother and Litigation Friend, Butler) v Burton Hospitals NHS Foundation Trust, the Court of Appeal allowed an appeal of the claimant against the previous finding in favour of the defendant hospital on causation of the claimant's birth injuries. The court found that the judge had based his judgment as to whether there had been negligence on the approach set out in Bolam v Frien Hospital, by looking at whether the consultant had acted in accordance with a responsible body of expert medical opinion. However, this was no longer the correct approach and the decision in Montgomery v Lanarkshire Health Board was the correct approach to use. The claimant, W, was born with cerebral palsy. They are among a growing number of MS patients who have made big lifestyle changes as part of a program, devised by Melbourne professor George Jelinek, which they say eliminated the symptoms of the disease that threatened to end their careers. Sam Gartland's future looked bleak when he was diagnosed with a relapsing remitting form of MS. His symptoms were so severe he had to quit his job as an intensive care doctor. "I couldn't actually walk from the car park to the intensive care unit," he said. A decade later, Dr Gartland spends his mornings either kickboxing or surfing on the New South Wales central coast. "I try and exercise every day," he said. "To the point where I'm sweating and my heart rate's up." MS remains the most common disabling disease among young adults. Skin creams have been linked to dozens of deaths in fires, leading to new warnings by manufacturers. Products used to treat conditions like eczema and psoriasis put users at risk because the paraffin in them can soak into their bedding or clothes, making them flammable. The medicines regulator has updated its guidance and it says all creams containing paraffin should carry a warning. There have been 37 deaths in England since 2010 linked to the creams, despite warnings going back more than ten years. Carol Hoes husband Philip died at Doncaster Royal Infirmary in 2006 when sparks from a cigarette ignited his moiturising cream. She told Radio 5 Live : Philip sneaked off on to a landing for a sneaky cigarette, a gust of wind must have caught the lighter, and it set fire to him. Within seconds Mr Hoe, who was having treatment for psoriasis, was engulfed in flames and he died shortly after. He was covered with 90% burns, said Mrs Hoe.There was nothing they could do.
